黄振渊:The press statement of SUPP Dudong Branch :The Malaysia Legal Practice Qualification Board (the Board hereinafter) has once again discriminated against the UEC.   砂拉越人民联合党都东支部的严正声明:有关马来西亚法律资格审查委员会(Malaysia Legal Practice Qualification Board) 再度歧视华文独中统考文凭一事。

 

The press statement of SUPP Dudong Branch :

The Malaysia Legal Practice Qualification Board (the Board hereinafter) has once again discriminated against the UEC. 

(1) In November 2017, the Board suddenly announced that the UEC would not be recognised by the Board and UEC students could not sit for the Certificate of Legal Practice ( CLP). 
At that juncture, SUPP Dudong Branch quickly  held a press conference openly accusing the Board for being discriminatory against and that decision was totally unfair to the UEC.
Our public appeal had caused a national uproar. As a result, under the enormous pressure of public opinion, the Board had to withdraw the rule, and the UEC students were able to continue to sit for the CLP. 

(2) However, on 5th June 2018, the Board introduced another new rule quietly which now stipulates that the UEC students who albeit have already obtained a recognised law degree, they still need sit for two subjects of the English “A" level or 2 STPM subjects if they wish to sit for the CLP. 

(3) On 26th October 2018, LPQB issued another notification which states clearly that pursuant to the notification dated 5th June 2018, the Board will also recognise the following qualifications for the application to sit for the CLP. 
(a) Sijil Asasi / Foundation dari Universiti Awam (UA) dan Institusi Pendidikan Tinggi Swasta (IPTS)
(b) Sijil Matrikulasi dari Kementerian Pelajaran Malaysia (KPM)
(c) Diploma dari UA, Institusi Pendidikan Tinggi Awam (IPTA) dan IPTS
(d) Ijazah pertama dari UA, IPTA, IPTS dalam Negara dan luar Negara
(e) International Baccalaureate Diploma
The two notifications of the LPQB clearly exclude UEC and are prejudicial to the UEC students. For the past decades, UEC students were allowed to sit for the CLP without the need of having to possess 2 “A” level or STPM subjects. 

(4) Due to the sudden introduction of new but ludicrous rule by the Board, many parents today have complained to SUPP Dudong Branch because this new rule has put UEC students into a dilemma and predicaments. UEC students who are still studying law at law schools locally or overseas will not be able to sit for the CLP after graduation.
If they want to become a practicing lawyer in Malaysia, they have no choice but to study in England and sit for the examination of the English Bar after graduation. However, due to the weak Malaysian Ringgit, the tuition and accommodation fees for the English Bar course will cost about RM200,000. During the present economic downturn, few families can afford it. The second option is sit for 2 subjects of "A" level or STPM after getting a law degree.

(5) The entrance system of any profession such as doctors, dentists, accountancy engineering, and law in the world is based on the results of the undergraduate degrees of the applicants. No professional association will pay attention to the applicants’ secondary schools results because the results of secondary schools are only relevant to the university undergraduate admissions. 

(6) Parents of the UEC students are of the view that this rule is not only unreasonable and unfair but the Board is seen to be highly discriminatory against the UEC students. 

(7) The new chairman of the Malaysian Legal Qualifications Review Board is the current Attorney General  Mr. Tommy Thomas.

(8) SUPP Dudong Branch hereby appeals earnestly to the Attorney General Mr Tommy Thomas who is the new Board chairman to convene an emergency meeting of the Board to delete such an unfair and unreasonable rule which is also meaningless and complete waste of time and money of the parents of these UEC students. 

(9) We also urge the Advocates Association Sarawak, Sabah Law Society and the Malaysia Bar to convene meetings to study the issue urgently and seriously. 

We also appealed to YB Mazelee, YB Teo Nian Chin and two MPs in Sibu YB Oscar Ling Chai Yew and YB Alice Lau assist these UEC students who aspire to become lawyers.

砂拉越人民联合党都东支部的严正声明:有关马来西亚法律资格审查委员会(Malaysia Legal Practice Qualification Board) 再度歧视华文独中统考文凭一事。

(1) 在2017年11月,马来西亚法律资格审查委员突然宣布独中统考文凭不在是受当局所承认的入学文凭之一。

当时砂拉越人民联合党都东支部就义无反顾的召开新闻发布会公开严厉斥责马来西亚法律资格审查委员会高度歧视和不公平对待对待华文独中文凭并要求全国人民,砂拉越律师公会,沙巴律师公会和大马律师公会,特别是华社一定要高度重视马来西亚法律资格审查委员的无理和不公平的决定。

我们的公开呼吁引起全国哗然。结果在舆论巨大的压力下,马来西亚法律资格审查委员不得不撤回有关规定,华文独中生也得以延续报考大马法律职业资格考试。

(2) 但是在2018年6月5日,马来西亚法律资格审查委员又静悄悄的通过了新的规定即华文独中生虽然已经考到了法律学位,但是假如要报考大马法律执照文凭(Certificate of Legal Practice,简称CLP),单凭华文独中文凭是不够的,还需拥有英国“A”水平两科或大马高级文凭(STPM)。

(3) 在2018年10月26日,马来西亚法律资格审查委员又发出另一道通知,该委员会也会承认以下的文凭学历认证为大马执照文凭的入学资格:

(a) 政府高等教育学府和私立高等学府颁发的大学预备班文凭,
(b) 大马教育部颁发的大学预备班文凭,
(c) 政府高等教育学府和私立高等学府颁发的大学预备班证书,
(d) 国内外的法律本科学历,
(e) 国际高级中学文凭(简称IB)

2018年6月5日和2018年10月26日的通告清清楚楚的把华文统考文凭排除出马来西亚法律资格审查委员承认名单。

这两份文告是发生在509大选后!

(4) 由于马来西亚法律资格审查委员会突如其来的荒谬新规定,昨天家长纷纷向砂拉越人民联合党都东支部投诉,因为这项新规定让许多华文独中生进退两难,制造许多的困扰。

因为没有“A” level或STPM 两科,正在海内外大学攻读法律的华文独中生将面对毕业后不能报考大马法律执照文凭(CLP)的困境。

他们若要成为执业律师,只好毕业后报读英国律师公会的考试。但是由于马币疲软,报考英国律师公会(English Bar) 考试的学费和住宿费等等则需每年大约马币二十万。在经济不景气的情况,没有几个家庭能负担的起这昂贵的费用的。

第二个选择就是在获取法律学位后再委屈的再报考两科“A”水平或STPM。总的一句话,这种新规定,明眼人一看就知道是刁难华文独中统考文凭,这是因为打从大马法律执照文凭30多年前设立后,华文统考文凭学历认证都不是问题,而且有华文统考文凭学历的律师在社会也有优秀的表现。

(5) 全世界的职业例如医生,牙医,会计,工程,法律等专业协会的入学考试制度都是以本科学位的成绩为标准,没有人会去理会中学的成绩,因为中学的成绩是大学的入学标准,而且中学的成绩也已经被有关大学审核了。

(6) 全世界也只有马来西亚法律资格审查委员会才会构想出如此荒谬的新规定来折腾独中生。家长们都纷纷表示这项规定除了不合理,不公平的规定,也显示马来西亚法律资格审查委员会高度歧视华文独中统考文凭。

(7) 马来西亚法律资格审查委员会新主席是现任总检察长Tommy Thomas.

砂拉越都东支部在此呼吁总检察长紧急召开会议,删除如此不公平,不合理,针对华文独中文凭的规定。

(8) 我们也呼吁砂拉越律师公会,沙巴律师公会和大马律师公会高度重视此事件并紧急召开会议讨论新条规所带给华文独中统考不公正的严重后果。

(9) 我们也呼吁马智礼,张念群,诗巫的两位国会议员林财耀和刘强燕大力协助华文独中生,让有意攻读法律的华文独中生如愿以偿。

我们更呼吁广大的华社要继续高度重视华教教育的问题,不能掉以轻心。
